These Terms of Use (“Terms”) govern your access to and use of candlebrain.com (the “Site”), operated by CandleBrain (“CandleBrain,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
You Must Test and Verify Everything Yourself
This is the single most important thing on this page, so we’re putting it first, in plain language:
Every calculator, formula, ratio, fragrance load suggestion, wax/scent blend recipe, dictionary definition, and piece of information anywhere on this Site is provided for general informational and educational purposes only. None of it is a substitute for your own testing, your own research, and your own judgment. Candle making involves open flame, hot wax, and fragrance chemicals, and mistakes can cause burns, fires, or property damage. Before you make, sell, or give away any candle or product based on anything from this Site, you must:
- Independently verify any calculation, ratio, or fragrance load percentage against your specific wax, wick, fragrance, and container — what works for one combination will not necessarily work for another.
- Follow your fragrance and wax suppliers’ own safety data sheets (SDS) and maximum usage guidelines, which override anything suggested here.
- Burn-test every finished candle before selling or gifting it.
- Comply with all labeling, safety, and regulatory requirements that apply in your location and market.
User-submitted recipes and suggestions (scent blends, wax blends, library links, supplier listings, dictionary terms) are contributed by other visitors or compiled from public sources. CandleBrain does not independently test, verify, or endorse any of it, and makes no representation about its accuracy, safety, or fitness for any purpose.
No Warranties
THE SITE AND ALL CONTENT, TOOLS, CALCULATORS, AND INFORMATION ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALCULATOR RESULT, RECIPE, OR PIECE OF INFORMATION IS ACCURATE, COMPLETE, OR SAFE FOR YOUR SPECIFIC USE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CANDLEBRAIN AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY, ARISING FROM OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SITE, ANY CALCULATOR RESULT, ANY RECIPE OR SUGGESTION FOUND ON THE SITE, OR ANY PRODUCT YOU MAKE BASED ON INFORMATION FROM THE SITE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR FIRE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CANDLEBRAIN’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless CandleBrain and its owners, operators, and contributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) any product you make, sell, or give away based on information found on the Site; (c) your violation of these Terms; (d) content you submit to the Site; or (e) your violation of any law or the rights of a third party.
Content You Submit
If you submit a suggestion, report, recipe, or other content through the Site, you represent that you have the right to share it, and you grant CandleBrain a non-exclusive, royalty-free, worldwide license to use, display, edit, and remove that content on the Site. We review submissions before they appear publicly and may reject, edit, or remove any submission for any reason, including safety concerns, at our sole discretion.
Do not submit anything unlawful, infringing, defamatory, or that you don’t have the right to share.
Third-Party Links and Suppliers
The Site links to and lists third-party websites and suppliers for your convenience. We do not endorse, control, or take responsibility for any third-party site, supplier, or the products/services they offer. Your dealings with any third party are solely between you and that third party — do your own research before ordering from or relying on any supplier listed here.
Intellectual Property
The Site’s design, logo, original text, and compiled content are owned by CandleBrain or used with permission, except for content submitted by users (see above) and information sourced from third parties. You may not copy, reproduce, or redistribute substantial portions of the Site without our written permission, other than for your own personal, non-commercial reference.
Acceptable Use
You agree not to: use the Site for any unlawful purpose; attempt to disrupt, overload, or gain unauthorized access to the Site or its systems; scrape or bulk-harvest content without permission; submit spam, malicious code, or abusive content; or impersonate any person or entity.
Changes to the Site or These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; continued use of the Site after a change means you accept the updated Terms. Material changes will be reflected by updating the “Last updated” date above.
Governing Law
These Terms are governed by applicable law without regard to conflict-of-law principles, and any dispute arising from these Terms or the Site will be resolved in the courts having jurisdiction over CandleBrain’s principal place of business.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
